How do you decide on how you will parent a kid or kids when you are not together with the other parent?
You need to consider two categories:
Decision-making responsibilities
and
Parenting time

What are Decision making responsiblities
responsibilities of the parents to make decisions about things like schooling, religion, health, etc.
it used to be the default assumption that ______ would be the primary caregiver, however as a society, we have accepted that all ______ can be excellent caregivers
Mothers ; genders
What factors effect the decision of having a primary parent as opposed to shared parenting
- high conflict
- location and practicality
- Parenting problems (eg.abuse)
- agreement
What happened in the Ross v Doehl case?
The plaintiff Ross had some kind of relationship with the defendant Doehl, Ross claimed that they were Adult Interdependant Partners and that he seeks partner support.
Doehl denied that they were adult interdependent partners
Why was the date Doehl’s wife moved out relevant?
a person cannot become an adult interdependent partner while living with his or her spouse
What elements did Ross need to prove to show that he and Doehl were in an adult
interdependent relatonship?
1.He and Doehl lived together for a continuous period of not less than 3 years;
2.During that 3-year period:
They shared each other’s lives;
They were emotionally committed; and
They functioned as an economic and domestic unit.
What did the judge conclude in the case?
That the parties were in a relationship of interdependance for a period more than three years
What did the judge decide about whether the parties functioned as an economic and
domestic unit?
She beleived that they did function as an economic and domestic unit because they both occupied a property, had relations with Doehls children, and financial interdependance
To be “living together” for three years, do the partes have to be residing on the same
property, under the same roof, for those full three years?
No they do not
There could be any number of reasons why parties choose to or must occupy separate residences.
For couples in Alberta who are separating, which of these situations does the Family
Property Act apply to?
o married couples
o adult interdependent partners who separated before Jan. 1, 2020
o adult interdependent partners who separated on or after Jan. 1, 2020
o couples who were not adult interdependent partners
Married couples and partners who seperated on or after january 1 2020
What is a disclosure statement?
A formal document that lists all assets, debts, income, and liabilities of a person
