Master Municipal Construction Documents
An Integrated set of contract documents forming the skeleton of a tender package
What is the MMCD specifically used for?

When should you not use MMCD?
- When a Lump sum/ Fixed Price contract is needed
- For Structural work
- For hazardous material cleanup
What are the measurements of success of the MMCD?
- Market penetration

Why is the MMCD a Unit Price Contract?
It is appropriate for less defined working conditions that municipalities encounter in some infrastructure works
What are the players in the MMCD?
- Owner
- Contractor
- Contract Administrator
- Superintendent
- Subcontractors
What is the Owner’s role?
- Owns site and risks
- Arranges for design, financing, owner permits, utility moves
- Engages contract administrator
- Tenders and selects contractor
What is the Contractor’s role?
Awarded Contract based on Tender
Once Awarded:
- strict compliance with all contract provisions
- full responsibility for site safety
- full choice of methods of construction
What is the Contract Administrator’s position? (C.A.)
- Mandatory position appointed by owner
- Authority is deep but constrained by exact wording of contract
What are the three potential conflicting roles of the CA?
- Represents the owner and ensures owner gets what was contracted
- Impartial Arbiter of Contract
- May be Representative of Designer and ensure design principles followed
What is the CA’s role?
- Focal point for contract communications
- authorizes payments
- gives instructions
- evaluates quality compliance
- monitors progress vs. schedule
What is the Superintendent’s role?
Responsible for:
- daily compliance with all contract quality and schedule terms
- site safety
- Means and methods of construction
- required testing
- responding to requests for quotations from CA
- providing and updating schedules
- Contractor’s records for claims
What is the difference between Change and Extra?
A Change is a deletion, alteration, or addition that the Owner wants to effect
If addition or alteration, it must be
- of a similar nature
- within place of work or immediately adjacent
If it does not meet above criteria, then it is Extra Work
List key parts of Change and Extra Work
Change
- mandatory for Contractor to comply and Owner to issue to Contractor
- Change order must be issued
- Payment negotiated or falls back to Force act
Extra Work
- Optional for both parties
- Contractor does not have to provide quote
- Owner can deal with others
- If awarded to Contractor, Change Order must be issued
- If others, Contractor mus co-ordinate
What are the Benefits of using MMCD
