The purpose of this form is:

To provide an objective, fair and balanced case and interview summary. It provides initial details of a case for first hearing at Court and must comply with the Criminal Procedure Rules.

To ensure that the file has been built to the required standard, with the supervisor certifying that the contents of parts 1 to 7 are an accurate summary of the available evidence in the case.

Operationally you will complete this form regularly so guidance and two completed MG 5s are attached for you to examine and refer to when necessary.

This form is used to inform the prosecutor of background information (some of which may be confidential) for an effective case review. It assists the prosecutor in considering both the evidential and public interest tests and also provides target dates for the supply of relevant types of evidence (e.g. medical information or information for compensation claims). This is also used to inform the prosecution of anything which may assist the defence, (e.g. forensic evidence which is not that of the defendant).

The purpose of this form is to inform the prosecutor as to why the defendant was not bailed and so presented straight to court by the Custody sergeant and makes recommendations for the prosecutor to request a further remand in custody from the court. It also states that should the court not remand the defendant then what bail conditions to ask for.

Witness information is contained within this form and provides the prosecutor with essential details such as the number of statements provided by each witness, whether the statements are attached and each witness has previous convictions and is vulnerable.

This form will never be passed to the defence. Hence the need for witness details (minus personal information) to be put on the MG5SP.

This form has been designed to encourage the use of the Proceeds of Crime Act against offenders. This form should be completed fully at the earliest possible stage if an acquisitive crime has been committed.

This form is to be used when the defendant has admitted additional offences and wishes the court to take them into consideration when sentencing.

The offences should be similar to the one for which the defendant has been charged, offences should be listed in chronological order, and both the front and rear of the form should be signed by the defendant.

This form is to be completed with the victim and estimates the value of loses incurred. This could include stolen property, other financial losses (loss of earnings and travelling expenses) and personal injury.
