What is the definition of Mental Disorder ?

A

An abnormal state of mind (whether of continuous or intermittent nature) characterized by delusions, or by disorders of mood, perception, volition or cognition of such degree that it:

  • poses a serious danger to the health or safety of that person or of others, or
  • seriously diminishes the capacity of that person to take care of himself or herself

What is a D.A.O ?

A

Qualified nurses who have specialized in the area of mental health and then received further training on an ongoing basis.

A

These are patients who are subject to a compulsory treatment order but are considered to present a danger to public

A

These are patients who are detained by way of a court order if they are found to be criminally insane or unfit to plead. The category also includes people on demand for a psychiatric report.

What is Section 109 Police powers in a public place ?

A
  • must be in a public place
  • must have reasonable belief they are suffering a mental disorder
  • then we can detain for assessment under the Mental Health Act (give them there Bill of Rights)
  • take them to:
    • hospital
    • Appropriate Place
    • Police station (last resort)

Can detain for max 6 hrs
