Define Mental Disorder
An abnormal state of mind (Whether continuous or intermittent)
Characterised by delusions, disorders of mood, perception, volition or cognition of such degree that it:
Poses serious danger to health/safety of that person/others.
OR
Seriously diminishes the capacity of that person to take care of themselves
Define Special Patient
Detained by Court Order.
Found Criminally Insane, unfit to plead or on remand for a psychiatric report.
Define Restricted Patient
Subject to a compulsory treatment order but are a present danger to the public.
Define DAO-Duly Authorised Officer
A qualified nurse who specialises in MH and receive further training on an ongoing basis.
Who may apply for another person to undergo a compulsory mental health assessment?
Any person over 18.
Normally doctors or relatives.
Section 109 MH Act-Detention Power
“In public out of their mind”
Power to detain a person in a public place who gives us reasonable belief they are mentally disordered.
Detain up to 6 hours to arrange for a medical examination.
Take to an appropriate place to be assessed-Hospital, DAO for examination.
Section 110C MH Act-Entry/Detention Power
“C-Concealed/Hiding”
Urgent assistance required for a medical practitioner to find and detain patients that have gone AWOL.
Special/Restricted Patients-No time limit to find and return to the hospital.
CTO:
-Within 3 months to find and return to hospital.
-Over 3 months-Deemed to be released from CTO and a new application for assessment must be completed.
Section 41 MH Act-Entry/Detention Power
“I’m a Doctor. Can you help with this one?”
Power to assist a DAO
-To enter
-Detain (6 hours)
-Transport patient for treatment/assessment-DAO must accompany
Section 112B MH Act-Use of Force
“Crazy force for you”
Power to use reasonable force to:
-Transport patient.
-Enter premises.
-Detain patient.
