What is meeting a young person for sexual grooming?
After having met or communicated with a young person the offender does the following:
- intentionally meets the young person
- travels with the intention to meet the young person
- arranges/persuades the young person to travel with the intention to meet him or her
and at the time of the arrangements he or she intends
-to do or have the young person do on him or her an act that would be a sexual offence if done in New Zealand
Who else can be included in definiton of a young person under this section
Any constable who pretends to be under the age of 16 if the offender believes that the fictitious young person was in fact a young person when taking any action.
What are the defences to this offence?
If the person charged can prove that
- before taking any action had taken reasonable steps to estalish whether the young person was of or over 16 years old and
- at the time they BORG that the young eprson was of or over 16 years of age
When is the offence complete?
When the parties meet or defendant travels or makes arrangements to meet the complainant with the relevant intent
When does this offence apply?
All cases where the offender or complainant is a NZ citizen or is ordinarily resident in NZ even if offence occurred outside NZ.
