marxism Flashcards
AO1-AO3
criminogenic-durkheim
state and law making- functionalism nhs/health and safety (adapt&change?)
selective enforcement-differential enforcements
ideological functions of crime and law- policing the crisis
criminogenic capitalism AO1
the nature of capitalism itself causes crime
based on the exploitation of WC for profits no matter the human cost eg primary/ fast fashion
WC commit crime as it’s the only way they can achieve consumer goods eg stealing, RC steal out of greed, tax evasion. Alienation of the WC leads to frustration and aggression, potential violence related crime
GAP
RC crime- notion of american dream causes people to amass property and get richer,
tax evasion to keep riches, Gordon- crime is in all classes, statistics make it appear a wc phenomenon
criminogenic capitalism AO3
Durkheim
the state and law making AO1
Law making and enforcement in interest of bourgeoisie
Chambliss- they brought in laws in order to protect private property, cornerstone of capitalism and vital to property owner ship
RC have power to prevent laws that go against them, and pass laws, through connections in courts and parliament, big down payments contributing to threat cause
eg introduction of british laws into african colonies, large tea and coffee plantations, needed plentiful supply of workers but population reluctant to help, enforced a taxation law that they could only pay off by working, earns money to pay it back, not only do RC benefit from labour but also profit from taxation
State and law making AO3
functionalism- state not just a caring face, introduce policies in ours/everyone’s favour ie health and safety and NHS
Selective enforcement AO1
the CJS picks and chooses who to arrest and charge- criminalise powerless groups like WC/EM and turn blind eye to RC crime
Reiman found significantly higher proportions of WC street crime prosecuted compared to RC, with CJS taking forgiving view
focuses on crimes of the streets, ignores crimes of the suites
eg Bhopal disaster, new union carbide factory would explode, carried on even though they knew chemicals would spread harm to save profits and no charge
selective enforcement AO3
differential enforcement
ideological functions of crime and law AO1
crime and law perform ideological functions- spread ideas to keep workers passive and distort perception of reality
caring face policies
Gordon- purpose to distract WC of their exploitation by directing frustrations onto inequalities and frustration produced by criminals within own class
safety valve to release aggression that could be directed at RC
ideological functions of crime and law AO3
policing the crisis- media creating moral panic over black muggers served to distract wc from crisis in capitalism to uphold ideology
neomarxism AO1
voluntaristic approach - free will
unequal distribution of wealth and power, crisis in capitalism, recession, unemployments
protests to police shooting, hold protests, vandalisms against harsh policies
community turn against rioters
scapegoating- rioters blames for moral breakdown of society, rioters feel sense of injustice and lose faith in CJS, DAS occurs
people clean streets
Neomarxism AO3
painted as robin hoods, steal from rich to give to poor, but doesn’t explain non utilitarian crimes
Marxism conclusion
deterministic- not all WC will commit crime as a result of exploitation, some may enjoy RC consumer products like iphones and live happy lives despite lack of status and capital
