Lesson 7 Flashcards
Putative Relationship
A putative marriage exists where one or both spouses believe in good faith that they are validly married, even though in fact they are not.
Putative Spouse
The spouse or spouses in a putative marriage that innocently believes the marriage to be valid. (If one of the spouses knows that the marriage is not valid, that spouse is not a putative spouse.)
Quasi-Marital Property
Quasi-marital property is all property acquired during a void or voidable marriage, in which one or both parties has the status of a putative spouse, which would have been community property or quasi-community property if the marriage had not been void or voidable.
“Marvin” or Meretricious Relationship
A meretricious relationship is one where both parties know that they are not validly married.
