Liability of Separate Property

A

Separate property is liable for (a) the spouse’s own debts, (b) debts for necessities of life for either spouse while living together, and (c) debts for common necessities incurred during separation unless spouses are living separate by agreement. The non-debtor spouse’s separate property is not liable for the debtor spouse’s debt whether incurred during or before marriage.

A

Community property is primarily liable for torts against a
third party when the act was for the benefit of the community. Community property is secondarily liable if
the act was not for benefit of the community.
