Section 87 what is the offence of not having a licence
offence to:
- drive or cause or permit another person to drive
- any class of motor vehicle on a road
- without a licencing allowing them to drive that class

You have stopped a motor vehicle and require them to produce either their driving licence and/or insurance certificate and they fail to do so.
If you have reasonable grounds to believe they are committing an offence under section 87(1) or 143.

Define a Moped
“a motor vehicle which has fewer than four wheels and:-
- Does not exceed 50cc
- Maximum speed does not exceed 30mph”
To hold a provisional moped licence and ride on the road a rider must:-
1) Be 16
2) Do Compulsory basic training and have a “certificate of completion”
3) Have L plates
4) Not carry a passenger (Pillion)
How do you get a full moped licence?
Accompanied rider test must be passed
When you pass a certificate of competence is issued that allows them to ride without L plates and carry a passenger (pillion)
This will be issued to the DVLA who will then issue the licence.
Define motorcycle
“a motorcycle is a mechanically propelled vehicle (not being an invalid carriage) with less than 4 wheels and not exceeding 410kg”
To hold a provisional drivers licence a holder must:
- Be 17
- Do compulsory basic training and have a certificate of completion
- Display L plates
- Not carry a pillion passenger
- Not ride on the motorway.
How do you get a full motorcycle licence?
Must take and pass a test within 2 years of the issue of a provisional licence, if this is not done provisional licence will lapse for another year.
You must pass an accompanied rider test.
The size and power of the motorcycle varies with the age of the rider.
AM, A1 and A2 relate to motorcycles of a restricted engine size and power which can only be issued to younger riders by way of a “progressive route”.
As the rider gains experience and grows older they can sit successive tests allowing them to ride more powerful motorcycles. Eventually getting a category A licence at 21 years old.
Riders who are 24+ can use the “direct route” allowing them to learn and be tested on larger capacity machines and be issued a licence in category A

Some important points.
- No trailers can be drawn, except by learners of agricultural vehicles and tractors.
- Provisional licence holder can drive on the motorway, but must be supervised by an approved driving instructor and the car fitted with duel controls.
When you pass you get a certificate of competence, this is valid for 2 years. If at the end it was not been submitted to the DVLA for a full drivers licence, the holder revers to being a provisional licence holder and had to retake the test.
