Define a road?
Road Traffic Act 1988
Any ways (other than a waterway) over which there is public right of passage (by whatever means) and whether subject to a toll or not and includes,
• the roads verges and any bridges (whether permanent or temporary) over which
• Or tunnel through which, the road passes and
• any reference to a road includes parts therof
Define “Public Road”
“A road which a roads authority has a duty to maintain”
A roads authority is either the local authority. In the case of a trunk road, central government.
Define Mechanically Propelled Vehicle (MPV)
Mechanically propelled includes propulsion by internal combustion engine, steam or electricity. A vehicle will remain mechanically propelled providing motive power can readily be applied or re- applied.
Give examples of mechanically propelled vehicles?
- Motor car with no engine but where the possibility exists that the engine may soon be replaced.
- Broken down vehicle which may be repaired
- A towed vehicle which could not be driven
- Stock cars, grass cutting vehicles, go carts, tanks
Define motor vehicle?
“Mechanically propelled vehicle intended or adapted for use on the roads”
A motor vehicle includes cars, vans, motor cycles, busses and lorries defines as above.
A motor vehicle must have some form of engine for it to be mechanically propelled. Most common of engine are petrol, diesel, gas and electrically driven.
Intended to be used on a road
Refers to cars, vans and lorries which are specifically intended or designed by the manufacturer to be used on a road.
Subsequently adapted
Refers to e.g. off road rally car not originally intended by the manufacturer for use on roads but an individual modified by adding indicators, mirrors etc to enable it to be registered for use on roads.
NOTE about MV and MPVs
All motor vehicles are mechanically propelled vehicles, BUT not all mechanically propelled vehicles are motor vehicles.
Expand on developments?
Increase in mini motos, quad bikes and e -scooters.
They are all MPVs as they have some form of mechanical propulsion.
They are also motor vehicles, even though the manufacturer has not intended that they be used on roads and they have not been adapted for use on roads
This is because as they are subject to the requirements of being insured, driver/rider having appropriate licence etc.
CASE LAW
Accused charged with driving a motor vehicle (mini moto) whilst disqualified from doing so. Held on appeal this mini moto was indeed a motor vehicle.
GENERAL RULE- if a reasonable person looking at these vehicles considered that one of their uses in their current state was for use on a road then they were indeed motor vehicles.
Define driving?
“A person is held to be “driving” when they have control of the speed and direction of the vehicle”
Give examples of driving
- Normal driving
- Being towed by another vehicle when the person in the towed vehicle has control of the steering and braking. This would not apply to a rigid tow.
- Pushing a car and jumping in as it gathers speed even although the engine is inoperative
