What other frameworks are available for managing a contract?
NZS 3902 - Residential Scale Projects
NZS 3915 - Similar to 3910. No engineer to contract. Client administers the contract.
NZS 3916 - Design and Construct
Outline the roles of each party under a NZS 3910 contract.
- It’s the industry standard conditions of contract for civil engineering works.
- Principle is the client. They are the source of funds. appoints engineer to oversee the contract on their behalf.
- Engineer to contract:
- Expert advisor + representative of principle.
- provides direction to contractor, certifies payments and acts independently and impartially under the contract.
- Engineers representative can undertake most administrative duties expect for certifying payments, issuing variations or make formal decisions unless authorised.
- MSQA - Management Surveillance and Quality Assurance.
How would you use a schedule of quantities throughout the lifespan of a project?
- It helps to generate a budget and allows provisional sums and contingencies to be measured.
- SoQ is a link between design and implementation. Sets out contractors understanding of project.
- SoQ provides a preliminary estimate of project.
How do you think the Treaty of Waitangi is relevant to Landscape Architecture?
- The values of the treaty are aligned to NZILA charter and statement of philosophy.
- Guides our thinking re: achieving a harmonious relationship between land and culture.
- Empowers communities to have guardianship over the land.
- Collaborate with Mana Whenua in a meaningful way.
- RMA references Treaty.
When is a Landscape Architect responsible for Health & Safety on site?
Always be vigilant on site and report any concerns to site manager. Site managers responsibility.
Tell us about a time you’ve engaged with iwi?
Viaduct Masterplan - Mei Hill + Graham Tipene. Overarching cultural narrative.
Graham is an example of a relaxed Mana Whenua engagement. He set us off on a path and we checked in at various point in time for feedback/direction. He was trusting of us to take the lead on landing that narrative in a meaningful way.
CMUA - Matapopere. Debbie Tikau.
This project is an example of a more closely knit working relationship with Mana Whenua. Nothing about us without us.
Navigational / celestial sculptural markers. Marrying functional requirements of the stadium in terms of lighting/way finding with a story presented by Matapopere.
Tell me about some of the challenges you faced during the overseeing of the project?

What’s the purpose of a specification?
- ## Provide details re: materials and workmanship required to achieve the design.
What is practical completion?
Practical Completion means the time when the Contract Works are complete save for Minor Outstanding Works.
Can you describe taking a project from tender stage through to completion under NZS 3910?
- Tender goes out (open/select/direct). Mahutonga deck was a selection of contractors based on consultant team’s past experiences/relationships.
- Tender queries received
- Tenders received and evaluated (cost/track record/experience/methodologies)
- Tender awarded (often with feedback).
- Contract finalised (awarded). Including contract documents
- Mobilised prestart
- Works commence
- Site visits/monthly payments.
- Practical completion
- Defects inspection
- PCC (Practical Completion Cert) issued.
- Site opens back to client. Payments released.
- Defects liability period commences.
- Final completion (defects remedied, full handover/release of payments).
