Section 504 0f Rehab Act - 1973
Prevents discrimination based on disability
Schools must provide equal access and opportunities by providing reasonable accommodations (This is NOT remediation)
No need to be eligible for special education to be eligible for Section 504
The Education for all Handicapped Children Act (EHA) -1975
All “handicapped” students have the right to a free and appropriate public education (FAPE) and this education must occur in the least restrictive environment (LRE). In 1986 (11 years later)- this was amended to be more all inclusive…………

Part H: incorporated Early Intervention Services (EIS) providing special services to qualifying children ages birth to 3 years old (age out on 3rd birthday). This includes OT, PT, ST, and special instruction. This is the state’s responsibility!
Part B: incorporated special education and related services to preschool children aged 3-5 years old who present with disabilities and/or qualifying delays. This is the school system’s responsibility! schools responsibility until they are 21 years old
must have 25% impairment to qualify
Related Services
Services needed to give the student access to their educational program
Occupational and Physical Therapy are related services in the school system

getting the child up and weight bearing. walking and reciprocical movement really affect their cognitive abilities.
