What are the three different types of lawyers?
- Barristers
- Solicitors
- Legal Executives
How many barristers are there and where do they work?
-13,000 (only 3k employed)
-self-employed, work in chambers and share administrative expenses with other barristers.
-Main employer is CPS.
What does a barrister do?
-advocate in court.
-negotiate, writing opinions + drafting documents for court.
What does the ‘cab rank rule’ mean in relation to barristers?
-take available case- no picking+choosing.
-does not apply if found directly (in small number of civil cases).
-usually instructed by solictors
How many solicitors are there and where do they work?
13,000- work within a private practice at a solicitors firm, CPS or gov. depts.
What does a solicitor do?
-centered around client.
-writing letters on behalf
-legal documents, wills + conveyances.
-can advocate as long as they have rights of audience in mags/ county.
What did Courts and Legal Services Act 1990 (CALSA) do?
-further training to access rights of audience in all courts.
-Known as solicitor advocates.
What is meant by a legal executive?
-A qualified lawyer who specialises in a particular area of law.
-qualified to carry out most solicitor roles but need supervision from solicitor/ barrister.
How many legal executives are there in England and Wales?
20,000
What is involved in a legal executives work?
-meet with client and give advice
-prepare documents
-limited rights of audience in mags/ county for some fam cases.
How can a legal executive apply for rights of audience?
Advocacy course.
