Criminal Law
Focuses on a behavior known as a crime with wrongs against a person, property, or society
Civil Law
Focuses on legal relationships between people and protection of a person’s right
Tort
Wrongful act not involving a contract(civil wrong)
Occurs when a person is harmed/injured because a healthcare provider didn’t meet an expected standard
Malpractice
Bad practice defined as the failure of a professional to use the degree of skill and learning resulting in injury, loss, or damage
Negligence
Failure to give care that is normally expected of a person resulting in injury
Assault
A threat or attempt to injure
Battery
Battery includes the unlawful touching of another person without consent
Informed consent
Permission granted voluntarily by a person who is of sound mind and who has been instructed about risks involved
Invasion of privacy
Physical invasion includes unnecessarily exposing individuals or revealing information without consent
False imprisonment
Restraining an individual or restricting an individual’s freedom without authorization
Physical abuse
Hitting, forcing people against will, restraining movement, deprivation of food and water, and not providing physical care
Verbal abuse
Speaking harshly, using inappropriate language to describe a person in a derogatory way
Psychological abuse
Threatening harm, denying rights, intimidating or ridiculing the person
Sexual abuse
Any sexual touching or act, sexual gestures, and suggesting sexual behavior
Domestic abuse
An intimate partner uses threats, manipulation, aggression, or violent behavior to maintain power and control
Defamation
False statements causing a person to be ridiculed or damage a reputation
Slander
Information spoken in defamation
Libel
Information written in defamation
Contracts
Agreement between two or more parties
Offer
Health care facility has treatment they can provide and individual offers to be a patient
Acceptance
Patient makes appointment with health care facility and accepts terms, health care accepts individual as a patient
Consideration
Patient receives treatment or services, provider receives payment
Implied Contracts
Obligations understood without verbally expressed terms
Expressed Contracts
Stated in distinct and clear language(orally/written)
