What is law?
Body of rules which are recognised as binding people of the community or state. It is an obligatory rule of conduct
MHRA
The Medicines and Health Regulatory Act are responsible for medicine legislation
Criminal law
Forbids actions that can be seen as a threat, harmful or endanger people’s health, safety and moral warfare
Civil law
Involves dispute between individuals/ organisations regarding property contracts and family ie. life situations
Professional indemnity insurance
Covers claims and legal fees that may arise if the patient suffers due to the Pharmacist’s negligence
Statute law
Includes acts of parliament which is termed as PRIMARY LEGISLATION. Also, this includes statutory instruments (SI’s) which are orders made under the acts. This is SECONDARY LEGISLATION
Indictable offences
Serious crimes; trial in crown court by judge and jury
Summary offences
Usually civil cases; less serious crimes tried in magistrates court
Either way offence
Mid level seriousness such as selling P meds in the absence of a Responsible Pharmacist
Discharge
Lenient sentence in criminal courts usually for minor offence. Person is discharged, being guilty without conviction
Fines
Most common type of penalty
Community orders
Community service under supervision or alcohol/ drug treatment
Custodial penalty
Person is sent to prison for a certain period of time or sometimes for life
Ancillary orders
Aimed to prevent future offences e.g. driving ban
Notifiable occupations scheme
Police can share information to regulating bodies e.g. GPhC of certain professions regarding a conviction
