Appearance notice
A legal document stating that the person to whom it is issued to is alleged to have committed a criminal offence, and requiring that person to appear in court in a specified time.
Information:
A written complaint, made under oath, stating that there is reason to believe that a person has committed a criminal offence.
Arrest:
To deprive a person of his or her liberty by legal authority so that he or she may answer to a criminal charge.
Summons:
An order to appear in criminal court; an order to a defendent requesting him or her to appear for trial to defend a plaintiff’s claim.
Warrant for arrest:
A document issued by a justice or judge to peace officers of a territory giving them the right to arrest an accused and bring him or her before the court.
Search warrant?
A document issued by a judge or justice or peace officers of a territory giving them the right to search a specific location, at a specific time, for a specific reason.
Telewarrant?
A warrant obtained by a peace officer, via telephone communication with a judge or justice, giving the officer the right to conduct a search.
Forensic science?
Science dealing with the application of medical science to law
Material witness?
A person whose evidence is important in the court of law
Venue
The location of a trial
Prima facie
On the face of something; something presumed to be true unless disproved by some evidence to the contrary. Enough evidence that someone could be guilty.
Disclosure
The crown is required to disclose its evidence so that the accused has full understanding of the crowns case and can prepare a defence. Even evidence that helps the defence.
Adjournment
Pushing off to another time
Bail
The amount of money or other security that is paid to insure the appearance of the accused in later proceedings
Show case hearings
A hearing where the crown or the accused must show why the accused should be detained or released pending trual
Undertaking
A court document signed by the accused saying they have been charged, must attend court, and follow the judges conditions
Duty council
A lawyer whose duty at a police station or a court room to give legal advice to those arrested or brought before the court
Recidivism
Relapse into crime
The return to prison of criminal repeaters
Search
To look for evidence that may be used in court of law
Recognizance
A document that promises the return of the accused to court and where they recognized they are alleged of an offence.
