Calendar of Cases

A
  1. Kept by the Clerk, under direct supervision of the judge
  2. A calendar for pre-trial, for trial, those whose trials were adjourned or postponed, and those with motions to set for hearing
  3. Preference shall be given to:
    - Habeas corpus cases
    - Election cases
    - Special civil actions
    - Those so required by law (S1R20)

Assignment of cases

A
  1. Exclusively by raffle
    EXC: Cases falling under the jurisdiction of the special commercial court or family court are assigned
    ETE: Unless two or more branches have been designated as special courts then it will be raffled among them (limited raffle)
  2. Done in open session
  3. Adequate notice given to afford interested parties opportunity to be present

Computation of Time

A

Things to note:

  1. Prescribed or allowed by the Rules
    - By order of the court
    - By any applicable statute
  2. How to compute
    The day of the act/event from which the designated period begins to run is excluded and the date of performance included. If the last day of the period falls on a Saturday, Sunday, or legal holiday in the place where the court sits, the time shall not run until the next working day. (S1R22)

NOTE: Calendar days includes weekends in the counting. The only time the weekends/legal holidays are omitted are when they fall on the last day of the period.

Effect of interruption:
Period starts to run on the day after notice of cessation of the cause of interruption
