Uniform Procedure (R5S1)

Rule 5, Section 1. Uniform procedure. - The procedure in the Municipal Trial Courts shall be the same as in the Regional Trial Courts, except (a) where a particular provision expressly or impliedly applies only to either of said courts, or (b) in civil cases governed by the Rule on Summary Procedure.

Revised Rules of Summary Procedure: Applicability of Regular Rules

A

Sec. 22. Applicability of the regular rules. — The regular procedure prescribed in the Rules of Court shall apply to the special cases herein provided for in a suppletory capacity insofar as they are not inconsistent herewith.

Revised Rules on Small Claims Court: Applicability of the Rules of Civil Procedure; Non-Applicability

Section 27. Applicability of the Rules of Civil Procedure. - The Rules of Civil Procedure shall apply suppletorily insofar as they are not inconsistent with this Rule.

Section 28. Non-applicability. - The rules on mediation/judicial dispute resolution shall not apply, inasmuch as the parties may enter into compromise at any stage of the proceedings.
