What is jus in bello?
An unjust war can be fought justly
1) no prohibited weapons
2) benevolent quarantine
3) distinction
4) no mala inse
5) no reprisals
6) proportionality at the tactical level
What is jus as bellum?
Justice before war. States must have:
1) just cause (self defense/prevent genocide/help allies)
2) right intention (do it for why you say)
3) last resort
4) proper authority and declaration
5) proportionality at the strategic level (no nukes for border skrmshes)
What is jus post-bellum?
Deals with the need for wars to end completely and fairly. Purpose:
1) assurances to combatants on terms to end conflict
2) terms for end of war
3) guideline for peace treaties
4) prevent fighting during peace negotiations for advantage
5) prevent draconian peace terms
What is Just War Theory?
JWT is a deductive, not inductive, way to order behavior vis-a-vis war based on ethics.
The idea that human dignity deserves to be respected.
Ethics v law: what is legal may not be “right” (law result of precedent, ethics not determinate).
