What form is used for claims against the department for 1,000$ or less! How long does a party have to file a claim?
CHP 287 / Claims should be filed within six months of the date of the alleged incidents. However, under certain circumstances, claims may be filed up to one year after the accrual of the cause of action. In addition the claimant must file a std. 204 payee data
What action is taken for claims in excess of 1,000$
Victim Compensation and Government Claims Board (VCGCB)
All claims in excess of $1,000 must be filed with the VCGCB. Pursuant to Government Code Section 945.4, claims must be filed within six months of the date of the alleged incidents. A CHP 268, Potential Civil Litigation Report, shall be completed and submitted to ORM if one has not been previously submitted. There is a $25 fee charged by the VCGCB for filing a claim.
What period is the budget year
The next state fiscal year, beginning July 1 and ending June 30
When is an employee considered to be on travel status
An employee is on travel status when employee is more than 50 miles from headquarters and more than 50 miles from the primary residence as determined by the normal commute distance.
When is per diem not allowed
Per diem is not allowed within 50 miles as determined by normal commute distance of the employee’s headquarters
What form must be filed for non-state employees incurring expenses
Expenses incurred by non-state employees whose travel expenses the Department has agreed to pay are claimed on CHP 82, Non-State Employee Expense Claim.
When is an assignment considered to be a long-term assignment
A long-term assignment is any assignment of 31 days or more to a given location other than the employee’s headquarters
