What is the Fire Safety Act 2021?

A

The Fire Safety Act 2021 amends the Fire Safety Order 2005 (FSO) to clarify that, in buildings with two or more sets of domestic premises, the FSO applies to these two elements: , the structure and external walls of the building, including cladding, balconies and windows; and all doors between the domestic premises and the common parts (e.g. entrance , doors to individual flats which open on to common parts). The effect of the Act will be to require fire risk assessments of buildings with two or more sets of domestic premises to be updated to take account of structure, external walls and doors, as described above, if they have not already done so.

A

From 15th June 2022, all new homes must produce 31% less CO2 emissions than what is currently acceptable in the present Part L regulations. Therefore, the construction of new dwellings must comply with the increased energy performance standards as set in the new regulations.

Exposed Façades in busy areas (main road etc) will require noise attenuating trickle vents. (Paragraph 1.54 Part F), All replacement windows must have trickle vents regardless of if the previous, windows did not. (Paragraph 3.15)

Describe the key parts of the Building Safety Act

  1. Introduces new dutyholder roles
  2. Building Safety Regulator (BSR) – which is the Health & Safety Executive – will become the building control body for new higher-risk buildings
  3. The golden thread of information

Reinforced Autoclaved Aerated Concrete

  • It has no aggregate
  • Used between mid 1950’s to mid 1990’s
  • Panels typically 600mm wide with champhered edges and bubbley look
  • Lifespan circa 30 years but affected by penetrations
  • Not as durable as concrete and impacted by poor original install or damage from water ingress.

  • Blocks of flats with their top storey more than 11m above ground level should be fitted with a sprinkler system throughout the building.
    -Wayfinding signage for the fire service should be provided in all blocks of flats with a top storey more than 11m above ground level.
  • Floor identification signs should be provided on every landing of a protected stairway and every protected corridor/lobby into which a firefighting lift opens.
  • Flat indicator signs to identify flat numbers should also be used and supplemented by arrows where necessary. Guidance is given on the location, font and size of signage.

Procurement Act 2023 - Due to come in to law in Feb 25 (Delayed 4 months). This will:
- Be more accessible, efficicient and beneficial for councils and suppliers
- clear framework for decision making
- open up public procurement to new entrants such as small businesses and social enterprises
- relax restrictions on considering factors like supplier location and social value, allowing councils more flexibility
- transparency throughout the commercial lifecycle so the spending of taxpayers’ money can be properly scrutinised

A

High court case. Large carried out a home buyers survey for Hart.
- Hart experience damp and water ingress resulting in a claim against large
- Large was found to be negligent: Failed to identify issues with damp, recommend further investigations or advise purchaser to obtain a professional consultants report.
- Highlights importance for surveyors to highlight areas not inspected and why, recommend further investigations where defects are suspected and recommend a professional consultants cert is obtained.

What is your understanding of the Bichard review?

A
  • Commisioned by the governing board in December 2021 into the purpose, governance and strategy of the RICS following the Levitt Review.
  • Had 36 recommendations incl. Commercial Activity to to be separated from other activities, RICS Matrics should give younger members a stronger voice through an improved governance structure, Diversity & inclusion panel, improved tech and a public interest panel.

What is the Levitt Report?

A
  • Commissioned by the RICS following a Treasury management audit in 2018.
  • Prior to audit RICS had to extend their overdraft by £3mill due to inaccurate cashflow forecasting
  • Report illuded to an internal power struggle due to its two board structure made up of a Management Board and Executive Board.
  • The report’s main recommendation is for a wide-ranging external review of purpose, governance and strategy, led by an independent reviewer. This was the Birchard review.
  • Governing council to have more oversight of internal dealings, be briefed by management board (Not CEO) and oversee exec management bonuses.
  • No evidence of illegal conduct.

Fees are being increased and part time concessions were being removed, however, following consultation with diversity & inclusion panels the part time concessions have been re-instated. Concessions have been ammended for 2025.

When applying for building control consent, how does it differ between high risk and low risk buildings?

A

High risk Buildings has gateways:

Gateway 1: Planning - Local authority consults with HSE for HRB’s

Gateway 2: Building Control Approval & Works - Building work can only start after approval is received from BSR (12 week determination)

Gateway 3: Completion certificates - Building cant be occupied once BSR issue completion cert and building is registered with BSR.

A

Independent Review by Alison Levitt QC on events following a 2018 Treasury Management audit:
- Four non-Executive Board members were wrongly dismissed for raising concerns about the audit.
- The governance structure allowed the Chief Executive and Chief Operating Officer to operate with little scrutiny.
- lack of clarity in roles and responsibilities, leading to governance failures and a power struggle rather than a cover-up
- Report calls for an external review of RICS’s purpose, governance, and strategy, along with interim recommendations on governance, executive remuneration, whistleblowing, and legal advice.
