What is the Hackett Review 2018?

A

Focuses on Fire Safety within the context of Building Regs following Grenfell Tragedy in 2017.

Dame Judith Hackett: review aimed to assess and improve the regulatory framework for fire safety and building standards.

Key Findings:
1. Regulatory Failures: overly complex, lack clarity therefore allowing for culture of non compliance. Lack of accountability.
2. Competency: need to improve the competency of those involved in the construction, maintenance, and management of buildings
4. Clear Responsibilities: review for defined responsibilities for building safety throughout the lifecycle of a building, from design to construction, to occupation. Proposed an accountable person.
3. Resident Engagement: better engagement with residents about concerns with fire safety
4. Building materials and testing: adequacy of the existing system for testing and certifying building materials, particularly cladding.

Hackett review is a catalyst for changing in UK building regs

Fire Safety Act 2021

A

Aimed at improving fire safety after Grenfell. Designed to provide clear guidance and legal requirements for building owners and managers.
1. Requires a responsible person to assess and manage the fire risk of buildings
2. Fire risk appraisals of external walls (FRAEW) reports need to be carried out on all multi-occupied blocks
3. Allow Fire Service to take action against responsible person if failure to comply
4. Regular inspections of lifts
5. Ensure evacuation plans in place
6. Ensure residents are provided with fire safety instructions
7. Ensure induvial flat entrance doors comply with current standards where external walls have unsafe classing
8. EWS1 forms required by financial institutions

A

External Wall Systems (EWS).

For mortgage lenders to enable valuation of tall resi buildings. It enables a ‘qualified professional’ to confirm external wall has been assessed

Criteria:
- Typically over 18m or 6 storeys
- Type of cladding and how much on building
- Presence of balconies and combustible materials
- Block of flats
- Student accom
- HMO’s

Grenfell Report Inquiry report Phase 1 and 2?

A

Split in to 2 phases: Chaired by Sir Marton Moore-Bick
1) Report published on 30th October 2019.
- Flames spread rapidly due to presence of ACM panels
- External wall system was not compliant with building regs.
Led to Fire Safety Regulations 2022
- Relates to external walls, structure and all doors in between of buildings

2) Report published on 4th Sept 2024
- Fire was accumulation of decades of failure by Central Govt. in combustible materials of external walls in high rise buildings
- 2016 Govt. was made aware but failure to Act
- Approved Document B
- Testing and marketing of Products: manipulate the testing processes, misrepresent test data and mislead the market.
- Tenant Management Organization: relationship between the TMO and its residents had been a troubled one for many years before the refurbishment of Grenfell Tower
- Management of Fire Safety and Grenfell: RBKC and the TMO were jointly responsible for the management of fire safety at Grenfell Tower.
- Refurbishment of Grenfell Tower: a high
- degree of compartmentation, thus rendering evacuation of the building unnecessary. The
- second is the tension between functional requirements of the Building Regulations and the
- prescriptive language of the guidance
- Outstanding Matters: Two matters remained outstanding from Phase 1. The first concerned the respective contributions to the fire made by the ACM rainscreen panels and the polyisocyanurate and phenolic insulation boards. The second concerned the mechanism by which the fire had escaped from the kitchen of Flat 16 into the external wall of the building.
It sets out recommendations:
- Approved Document B was poorly worded and liable to mislead designers – needs to be reviewed
- Regulation: Building Safety Regulator
- Higher risk buildings “higher-risk building” in the sense in which it is used in the Building Safety Act, that is, a building that is at least 18 metres in height
- government bring responsibility for the functions relating to fire safety
- Secretary of State appoint a Chief Construction Adviser with a sufficient budget and staff for mentioning, advice, and guidance
- Fire performance test and strategy

What cladding is bad?

A

Aluminium Composite Material (ACM) cladding - rapid spread of the fire. The combustible insulation behind the cladding also intensified the fire.

Occupiers Liability Act 1972
Occupiers Liability Act 1984

A

1972: The Act regulates liability of occupiers for injuries caused to lawful visitors. Those who have control over premises are also liable. Reasonble to think visitors will be safe using the premises.

1984: governs the duty of care owed by occupiers of premises to people who enter the premises without permission, often referred to as “trespassers.”

Obligations by ‘duty holder’. Get a survey to make a material assessment.

What would you do if you suspected asbestos existed on a site inspection?

A
  • I am aware that properties built prior to 2000 may have the presence of asbestos in them.
  • If I suspected asbestos whilst on inspection, I would assess whether the asbestos is damaged or disturbed. If it is disturbed, I would inform the duty holder ASAP and advise them on the emergency measures required and who to contact to obtain specialist advice.
  • If the asbestos was not damaged or disturbed, then I would request the asbestos management plan from the duty holder.
