Duty to every employer to ensure, so far as reasonably practicable, the health safety and welfare at work for all employees.

What is the difference between risk and hazard?
Hazard is likely to cause harm
Risk is the potential of someone people harmed
What is a Risk Assessment?
Legal obligation for a firm with 5 or more enplyoers.
Outlines:
1. Identify the hazards present
2. Identify the people at risk of these hazards
3. Evaluate risk
4. Record findings
5. Review the risk assessment regularly
6. Advise all those affected by risks and how to mitigate them
What is a method statement?
A document details way a work task or process is to be completed prior to approval.
- Outline hazards + step by step guide on how to do job safely
- Details control measures
What is public liability insurance?
Required if there is 5 or more employees:
1. Policy which sets out companies commitment to H&S
2. Details of H&S structure, roles + responsibilities
3. Risk assessment
4. Planning and implementation of H&S policy.
What is the 6 pack of H&S Regulations?
Introduced in 1993 and complies with duties under Health & Safety at Work Act 1974:
1. Management of H&S at Work
2. Display Screen Equipment
3. Manual Handling Procedures
4. PPE at work
5. Provisions and Use of Work Equipment
6. Workplace Health and Safety welfare
Reporting Injuries, Diseases and Dangerous Occurrences Regulations 2013 (RIDDOR)?
Trigger date of reporting injuries is over 7 days incapacitation.
- Reported to HSE within 15 days from date of incident
- Keep record of all 3 day + injuries
- Kept in incident book for min 3 years
Corporate Manslaughter and Corporate Homicide Act 2007?
Gross breaches of a duty of care by corporate body leading to persons death.
- Unlimited fine, imprisonment and disqualification as company director
What is the key fire safety legislation?
Regulatory Reform (Fire Safety) Order 2005 –
* Places duties on the ‘responsible person’ of non-domestic properties to take reasonable steps to reduce the risk from fire
* Risk assessment must be undertaken
The Fire Safety Act 2021 –
* Following the Hackitt Review (2018)
* Relates to multi-occupied buildings
* Requires responsible persons to assess, manage and reduce fire risks posed by the structure
Fire Risk Management Regulatory Reform (Fire Safety) Order 2005?
Bases on risk assessment with emphasis on fire prevention.
- Applies to non domestic property in UK
- ‘Responsible Person’ is the employer or occupier
- Fire precautions in place following risk assessment
- Record keeping, staff triaing
- Regular review of risk assessments
- Reasonable fire precaution measures

What to fire precaution measures include?
- Fire detection
- Warning alarm system
- Fire-fighting equipment – inspected and in date
- Safe exit routes

What is the Hackett Review 2018?
Focuses on Fire Safety within the context of Building Regs following Grenfell Tragedy in 2017.
Dame Judith Hackett: review aimed to assess and improve the regulatory framework for fire safety and building standards.
Key Findings:
1. Regulatory Failures: overly complex, lack clarity therefore allowing for culture of non compliance. Lack of accountability.
2. Competency: need to improve the competency of those involved in the construction, maintenance, and management of buildings
4. Clear Responsibilities: review for defined responsibilities for building safety throughout the lifecycle of a building, from design to construction, to occupation. Proposed an accountable person.
3. Resident Engagement: better engagement with residents about concerns with fire safety
4. Building materials and testing: adequacy of the existing system for testing and certifying building materials, particularly cladding.
Hackett review is a catalyst for changing in UK building regs
Fire Safety Act 2021
Aimed at improving fire safety after Grenfell. Designed to provide clear guidance and legal requirements for building owners and managers.
1. Requires a responsible person to assess and manage the fire risk of buildings
2. Fire risk appraisals of external walls (FRAEW) reports need to be carried out on all multi-occupied blocks
3. Allow Fire Service to take action against responsible person if failure to comply
4. Regular inspections of lifts
5. Ensure evacuation plans in place
6. Ensure residents are provided with fire safety instructions
7. Ensure induvial flat entrance doors comply with current standards where external walls have unsafe classing
8. EWS1 forms required by financial institutions
Who is a responsible person?
Assessment of external wall system and executive summary that the mortgage valuer can be used to establish remediation works are needed or not to ensure the fire safety of a building
EWS1 Forms, what is it?
External Wall Systems (EWS).
For mortgage lenders to enable valuation of tall resi buildings. It enables a ‘qualified professional’ to confirm external wall has been assessed
Criteria:
- Typically over 18m or 6 storeys
- Type of cladding and how much on building
- Presence of balconies and combustible materials
- Block of flats
- Student accom
- HMO’s
Valid on a building for 5 yrs.
What is the outcome of an EWS1 assessment?
Cat A1, A2: materials in external walls are unsafe and no remedial work is needed
Cat B1,B2: Some material may not meet the necessary fire safety and remedial action is needed
Building Safety Act 2022?
Following the Hackett Review, this legislation was introduced to enhance regs for fire safety + ensure residents have a stronger voice.
Looking to strengthen:
- Accountability to those responsible for high rise buildings
- Residents ability to contribute to maintaining safety
- National framework to ensure suitability of construction materials
- Requirement for new developers to join the New Homes Ombudsman Scheme
Key Provisions of Building Safety Act include?
- Introduced a Building Safety Regulator: over seas safety and standards
- The Building Safety Regulator is the Building Control Body
- HSE is responsible for verifying building works to ensure they meet standards
- Golden thread of info now required for each higher risk building
- New high rise buildings must now be registered before they are occupied
