What is the main legislation relating to Health & Safety?
- Health and Safety at Work Act 1974
What is included in the Health and Safety at Work Act, 1974?
- Duty to every employer to ensure, so far as reasonably, practicable, the health, safety & welfare at work of all employees
- Policed by the Health and Safety Executive (HES) as a criminal offence – fines and/or imprisonment
- Must report injuries and dangerous occurrences
- Must undertake, record and regularly review risk assessment
- Hazard refers to anything that has the potential to cause harm
- The probability/likelihood that someone will be harmed is a risk
- Detailed H&S information should be held on site, usually in the Operations & Maintenance manual
When is a risk assessment required?
- Legal requirement for all firms with 5 or more employees to carry out a risk assessment of all significant hazards
What must be included in a health & safety policy document?
- FOUR points:
1. Policy setting out organisation’s commitment to health and safety
2. Details of H&S structure, with roles and responsibilities for organising H&S
3. A risk assessment setting the risk within the workplace and preventative measures in place
4. Details of planning, implementation od the H&S policy and control measures

What do you understand about Asbestos?
- Covered by the Control of Asbestos Regulations 2012
- Three types (white, brown and blue)
- Duty of care is with landlord
- Risk assessment must be place and management plan
- No risk if undisturbed
What are the two types of asbestos survey?
- Management survey
o To locate and assess asbestos and advise on its management during normal occupation and use of premises - Refurbishment/demolition survey
o Required where premises, or part, need upgrading, refurbishment or demolition
o Samples of materials suspected of containing asbestos are taken and analysed
o Recommendations are made regarding their management
Where would you find asbestos?
- In buildings-built pre-2000 (white banned in 1999 and the others 1985)
- Was commonly used as insulation
- Also find in ceiling tiles and flooring materials, roof cladding in industrial property
What are the obligations set out within the Control of Asbestos Regulations?
- Obligation on the duty holder
- Obligation on employers
What would you do if you observed asbestos unexpectedly during an inspection?
- I would photograph the suspected asbestos and the condition
- Immediately notify my client to undertake an asbestos management survey
- Ensure it was safe to continue the inspection
- If in doubt, assume materials contain asbestos
What course of action would you take if your client’s building contained asbestos?
- Notify my client to undertake an asbestos management survey to assess whether the property contains asbestos to be undertaken by a licenced asbestos contractor
- Assess the risk and produce an asbestos management plan – is encapsulation or removal needed
- Produce an asbestos register
- Make the register available to all relevant parties who might disturb it
- Review register regularly (HSE recommend 6 monthly)
