H-2B Processing Definitions (Medium) Flashcards
Request for Evidence
An inquiry issued by CIS during the visa petition process. An RFE is a formal request by CIS for the employer to submit additional evidence or documentation relevant to the petition.
Dates of Need
The first and last date on which the employer requires the services of H-2B workers (i.e., the H-2B contract start and end date).
Job Order
A document containing all terms and conditions of employment, as well as disclosures and attestations required under the H-2B program regulations. The Job Order must be placed with the SWA. For H-2B, this occurs concurrently with the H-2B application to DOL. The purpose of the Job Order is for the SWA to attempt to find local workers to fill the available job positions.

A proprietary system mas Labor uses to support Case Managers and guide clients through the stages of the H-2B application process.
Initial Report of Recruitment
The report that can be submitted to DOL after the first initial 15 business days of recruitment have passed.
Notice of Acceptance
A notice issued by DOL informing the employer that its H-2B application has been accepted for processing. The NOA provides instructions regarding the employer’s recruitment obligations as well as a deadline for the employer’s IROR.
Notice of Deficiency
A notice issued by DOL requesting or requiring modifications to the Job Order or H-2B application, or asking the employer to submit additional documentation or explanation.
Temporary Labor Certification (or Tender Loving Care)
A form issued by DOL certifying an employer has a need for H-2B workers. This form is sent with a visa petition to CIS for approval of H-2B visas.
Final Report of Recruitment
The report the employer retains for auditing purposes after the entire recruitment period has been completed (21 days before the start date)
Metropolitan Statistical Area
A geographical region with a relatively high population density at its core and close economic ties throughout the area. BLS does surveys of these MSAs to determine appropriate wages for various job classifications.
