What is a MOU/MOA grievance?
-A written allegation of a violation of a specific term in the MOU/MOA. Must state facts, specify the MOU/MOA provision violated and remedy requested
What is an A.R. 2.61 grievance?
-A written allegation concerning the interpretation or application of rules and regulations regarding personnel practices, working conditions or improper treatment that has not been satisfactorily resolved through an informal process.
What must an A.R. 2.61 grievance state?
- A clear indication of unfairness resulting in harm to the employee
- Arise from an act or omission from management related directly to working conditions or the employee relationship
- Must be controllable by the Chief
- Must state the action requested
What are the steps for a MOU grievance if it is not resolved by informal resolution?
Step 1: Officer must file a written grievance within 14 days of the incident. The supervisor must file a written response within 14 days of receiving the grievance.
Step 2: If the grievant is not satisfied, they may appeal the decision to the commander by submitting the form within 14 days. The commander must respond within 14 days.
Step 3: If not satisfied or resolved, the grievant may appeal to the Chief within 14 days. Chief must respond within 14 days.
Step 3.5: The parties may agree to submit the grievance to the Labor Relations Administrator.
Step 4: If the Chief’s response does not resolve the issue, the grievant may appeal to the Grievance Committee within 14 days. The Grievance Committee will schedule a hearing or the grievant can request an arbitrator. The recommendation of the Committee or arbitrator will be submitted to the City Manager who will make the final determination.
