If it is determined MVARS equipment is in need of repair & is under warranty:
Warranty related repairs will be arranged by Area MVARS coordinators/supervisors
Directly through Watch-Guard service technicians.

If it is determined that the MVARS equipment problem/damage is not under warranty:
Notify Research & Planning Section MVARS coordinators via e-mail at: MVARS@chp.ca.gov.
The Division/Area will need to request an “X” Number for repairs.

What is a threshold incident?

A

Defined as those incidents which have a high probability of resulting in the Department or the State of California as a defendant in a civil lawsuit.
CAT A: Incident involving death of dept member, suspect, bystander Immediately notify ORM and ENTAC.
CAT B: Dept member intentionally fires firearm at someone, internal investigation with dept liability, critical incident that can affect morale. Notify ORM next business day.

What is the Fourth Amendment?

A

It prohibits unreasonable searches and seizures of people, houses, and personal property. Requires probable cause for a search warrant
When does a search or seizure occur? (GO 100.91)
A search occurs when an expectation of privacy that society is prepared to consider reasonable is infringed.
A seizure of property occurs when there is some meaningful interference with an individual’s possessory interest in that property.
A seizure of a person occurs when a peace officer physically applies force, or when a person voluntarily submits to a peace officer’s authority.

What is reasonable suspicion?

A

Reasonable suspicion is the belief that (1) something related to a crime has just happened, is happening, or is about to happen, and (2) the vehicle or the person in the vehicle stopped, detained, or contacted (or pedestrian detained or contacted) is connected with that activity.

The CHP 202D/CHP 216 is not required in what circumstances?

A

Pat-down/frisk searches when no weapons, contraband, etc., are found & no arrest is made.
Vehicle inventories.
Searches conducted incidental to a lawful arrest (e.g., if an arrest results in a subsequent search or inventory of the suspect’s vehicle or person, a CHP 202D is not required to be completed).
CHP 202D is not required to be completed for the following:
(a) Parole or probation searches.
(b) Pat-down (Terry) searches when no weapons, contraband, etc. are found.
(c) Pre-storage/impound vehicle inventories.
(d) Searches conducted incident to a lawful arrest (i.e., an arrest resulting in a subsequent search or inventory of the suspect’s vehicle or person).
Note: Probable cause searches include when an officer is conducting a Terry Pat/Frisk, & feels what he/she believes to be a weapon, contraband, etc. In the instances, the officer has developed a probable cause to make intrusion into the suspect’s clothing or property &, therefore, a CHP 202D shall be completed

For searches of persons who are on parole, searchable probation, or Post-Release Community Supervision when no contraband is found, a dispatch log number and identifying information is entered into the CHP 415, Daily Activity Report.

A

Pat-downs/frisks: Document on CHP 415, consistent with HPM 40.71, CHP 415 User’s Manual, Chapter 10, verbal warnings.
