Role of International community?

genocide convention:legal responsibility

A
  1. A person that commits a crime under international law will be responsible
  2. State doesn’t have a law against act, but international community does the person will be held responsible
  3. Ones position in gov., head of state, does not provide exemption from being held responsible
  4. Simply following a direct order, does not provide exemption from punishment-moral choice was possible

A

24 Nazi’s put on trial
-charged w/ crimes against peace, humanity, & rules against war.
-Nazi’s argued the could not be convicted
This lead to the Genocide Convention by Truman however the senate did not understand and feared their past actions could be looked as genocide
