When is planning permission needed?
Planning permission is only needed if the work being carried out meets the statutory definition of ‘development’ which is set out in section 55 of the Town and Country Planning Act 1990.
‘Development’ includes:
building operations (eg structural alterations, construction, rebuilding, most demolition);
material changes of use of land and buildings;
engineering operations (eg groundworks);
mining operations;
other operations normally undertaken by a person carrying on a business as a builder.
subdivision of a building (including any part it) used as a dwellinghouse for use as 2 or more separate dwelling houses
When is Building Regulations approval needed?
The Building Regulations 2010 cover the construction and extension of buildings.
You might also need building regulations approval for many alteration projects, including if you plan to:
replace fuse boxes and connected electrics
install a bathroom that will involve plumbing
change electrics near a bath or shower
put in a fixed air-conditioning system
replace windows and doors
replace roof coverings on pitched and flat roofs
install or replace a heating system
add extra radiators to a heating system
What is the difference between an approved inspector and Local Authority Building Control?
What is the difference between the local authority building control vs private approved inspector, although they have to follow the same rules and regulations, there’re still some differences between them. One being the application process is a bit different.
With private building control, they will apply for approval. They must also give ‘initial notice’ to the local authority, letting them know about your building project.
Upon completion, the private building inspector will issue a completion certificate, which is a final certificate to the local authority to confirm the work has been completed in line with building regulations.
If you use a local authority building control inspector, you’ll need to apply yourself for approval via the government planning portal.
Which work does not need Planning permission?
Some building projects do not need planning permission. This is known as ‘permitted development rights’.
Building projects that normally have permitted development rights include:
- industrial premises and warehouses
- some outdoor signs and advertisements - though there are special rules around adverts
- demolition - but before you begin you must get approval to - demolish from your local planning authority (LPA) through your local council
- Dormers if not facing street
- Rear extension if not more then 50% of curtiledge of building

What are the building regulations?
The building regulations help ensure that new buildings, conversions, renovations and extensions (domestic or commercial) are going to be safe, healthy and high-performing.
Detailed regulations cover specific topics including: structural integrity, fire protection, accessibility, energy performance, acoustic performance, protection against falls, electrical and gas safety.
They also lay standards for drains, ventilation, protection against the ingress of water and protection against contamination including methane and radon gas.
The building regulations are defined by the English and Welsh Governments.
What is the statutory period for a decision of a planning application?
Between 8 and 13 weeks with a maximum of 26 weeks to achieve the planning guarantee
What does the Construction Act 1996 bring in?
Provisions of the Construction Act include:
The right to be paid in interim, periodic or stage payments.
The right to be informed of the amount due, or any amounts to be withheld.
The right to suspend performance for non-payment.
The right to adjudication.
Disallowing pay when paid clauses.
