What are the differences between Criminal and Civil Law?
Criminal Law is against the state: the guilty can be fined or imprisoned. Eg failing to comply with Health and Safety at Work Act 1974.
Civil Law is against individual parties, and can result in compensation.
If an employer fails to provide adequate PPE for instance; they would be punished under Criminal Law but compensate the employee under civil law.
What rights do the HSE or EHO (Environmental Health Officer) have?
- Enter without warrant
- Talk to Employees & take photos
- Expect cooperation
- Issue Notices of improvement or cease usage
- prosecute a business or individual
The HSE can charge an FFI fee for intervention of £129/hr

Everybody
Employers and Controllers of the Premises have the main duties:
- Ensure safety of staff and others
- Provide safe systems and equipment
- Ensure safe handling and use of substances
- Provide info, training and supervision
- safe place of work
- Provide adequate facilities and conditions.
What duties do employees have under the Health and Safety at Work Act 1974?
- Take care of their own H&S and that of others who could be affected by their actions
- Cooperate with others on matters of H&S
- Not interfere with or misuse anything related to H&S
- Inform others of apparent dangerous practices or sisuations
What must you do to create a competent Risk Assessment?
- Understand the requirements of legislation
- Understand the terms Risk and Hazard
- Be competent in identifying hazards contained in the task, premises or process
- Conduct the risk assessment within the employer’s policy and procedure.

What is the difference between a risk and a hazard?
Hazards have potential to cause harm
Risks are potential harm if the hazard becomes realised
For instance a banana on the floor is a hazard- the risk is tripping and hurting yourself
Risk is calculated as Likelihood x severity
