unless they are under arrest by virtue of other legislation or warrant

what type of sample can UOF be used for
UOF conditions can be used for intimate samples
when obtaining of blood samples

If it appears as though that UOF is going to be used
What must the requesting member do
- Notify independent sub-officer
▪️Sub-officer must attend, investigate why the person will not provide a sample
▪️Sub-officer must attempt to facilitate reasonable request (i.e Speaking to lawyer)

If practicable, what must PO who is facilitating the sample being taken, have to comply with in relation to UOF
- Be of the same sex of the suspect giving the sample
- Not be involved in the investigation for which the sample is being collected
