What is the Defn of
Forensic Procedure
Taking a sample from any part of the body
which are
▪️ intimate
▪️ non-intimate
▪️ any other sample
▪️ any procedure or physical examination of the body
Does Not include samples from
fingerprints or DNA profile
What FP samples are
Non-intimate
- Hair, not pubic hair
- Under fingernail or toe nail
- Swab
▪️ washing or sample from external of body
▪️ not anal, genital or breast of female
What samples are
Intimate
- Saliva
- mouth scraping
- Blood
- Dental impression
- Pubic hair
- Body swab external
▪️ genitalia/anal
▪️ female breast
What is the Defn of
Compulsory Procedure
- Taking of an
intimate/non-intimate sample.
- Conducting a
physical examination
What samples are needed
for the purpose of deriving a DNA profile
Sample taken for purpose of deriving DNA profile -
- Blood sample
- Hair other than pubic hair
- Saliva
- Scraping taken from the mouth
When must DNA evidence ONLY be used
- Where there is additional corroborative evidence.
to prove or disprove that an offence has taken place
- Unless exceptional circumstance exist.
i. e AO has committed rape
