A

Marriage, procreation, contraception, childrearing

What rule applies to abortion?

A

Normal strict scrutiny analysis does NOT apply, bc gov has two compelling interests.

  • Pre-viability –> state may adopt regulation protecting mother’s health and life of fetus, if reg doesn’t put “undue burden” on woman’s right to obtain abortion
  • Post-viability –> State’s interest in fetus’s life can override the woman’s right to obtain an abortion, BUT state cannot prohibit woman from obtaining abortion if it’s necessary to protect the woman’s health or safety

With regards to pre-viability abortion restrictions, what are examples of valid and invalid laws?

A

Undue burden:

  1. requiring woman to notify spouse of abortion
  2. requiring physicians who perform abortions to have admitting privileges at nearby hospital

Not Undue burden:

  1. Requiring doc to giv relevant info for informed consent
  2. 24 hour waiting period
  3. Parental consent/notice for minors (with judicial bypass option)
  4. Requiring that abortions be performed only by licensed physicians
  5. Barring partial birth abortion if other options are available

What is the rule regarding obscene material?

A

Right to privacy includes right to read obscene material in one’s own home (except child porn) (but not necessarily right to transport, sell, buy)

What is the “one person one vote” principal?

A
  • applies to any level of gov, which selects representatives from individual districts (you count total population, not those eligible to vote)

Exceptions:

  1. appointed officials
  2. at large reps
  3. special purpose elections (water districts)

Congressional Elections:

  1. States –> must use “almost exact mathematical equality” when creating districts within state
  2. Congress –> gets more deference

State/Local Elections:
Variance in number of persons cannot exceed a few percentage points

What are the rules re: gerrymandering?

A

Race (and presumably other suspect classifications) cannot be the predominant factor in drawing boundaries of voting districts UNLESS it passes strict scrutiny

A
  • to avoid gerrymandering, states can use independent commissions to draw districts

What is the rule re: candidate qualifications?

A
  1. fees may not prevent indigents from running for office
  2. Ballot access regulations must be a REASONABLE, NON-DISCRIMINATORY means of promoting IMPORTANT state interest.

NOTE —> state may require candidates show reasonable support to be on ballot

A

Gov MAY allocate more public funds to two major parties than to minor parites

What issues arise with right to interstate travel?

A
  • Individual has fundamental right to move to new state and be treated equally when arriving there.
  • HOWEVER –> not every restriction on right to travel is an impairment of right to travel (Example –> increased penalty for father abandoning kids and leaving state)
  • Problem usually arises when state imposes minimum durational residency requirements for benefits.
  • It is not clear whether strict scrutiny is always applied

What are examples of valid/invalid durational residency requirements (w regards to interstate travel)?

A

Invalid:

  1. one year residency for welfare
  2. one year residency for state-subsidized healthcare
  3. one year residency to vote

Valid:

  1. 30 day residency to vote
  2. 1 year residency to get divorced

What is the rule re: right to international travel?

A

international travel is NOT a fundamental right

HOWEVER –> it is protected from arbitrary interference by 5th amendment DP clause. Rational basis standard applies
