Federalism part 2 Flashcards
What is the first advantage of federalism?
It helps spread out the power
Is there a way the states can take any power from the government they want?
Yes, states are able to propose and ratify amendments to get what they want but the government can only propose
What is the second advantage of federalism?
It encourages experimentation
If there is a problem, the government lets the states try to solve it- if their solution works out, the nat gov could spread the idea nation wide
If it screws up, there are 49 other states to try something else
Ex: marijuana
What is the third advantage of federalism?
It allows states to have independence
Specifically on how to solve problems- we allow individually places to take care of their own problems
Ex: Texas and Chicago- had two different approaches but both had the same effect
Not a 1 size fits all approach
What is the first power of the national government?
Expressive power
These powers are given to the nat gov because they are expressively written in the constitution
What is the second power of the national government?
Implied powers-
National has to carry out their expressed powers
Ex: pick up sibling bc parents asked, parents mad you did not ask to take the car although it was implied
Expressed: pick up sibling
Implied: take the car
How else?!
What is the third power of the national government?
Inherent-
Those that the nat gov have because there is no other level that could practically do that job
States can use 10th amendment to say what really gives the gov the right to do that
What sets the foundation of implied powers?
Necessary and proper clause or aka
Elastic clause
How is congress able to expand their powers?
By making a law to carry out their job
