Criminal Law
Govt = Plaintiff, punishment involves fines and sometimes imprisonment,
Civil Law
Involve disputes among individuals, groups, and other private entities, punishment. = punitive, monetary payments
Trial courts
Original jurisdiction, responsible for discovering facts in controversy
Court of Appeals
Have appellate jurisdiction, judges receive cases after the factual record is established = new facts cannot be presented in appellate courts
State Trial Courts
First court to hear a criminal or civil case, by jury or judge = original jurisdiction only
State court of appeals, then state Supreme Court
