The president’s powers
Five Powers (5) = Military, Judicial, Diplomatic, Executive, Legislative
Expressed Powers
Specific powers granted to the president under Article 2 of the constitutions
Expressed Military Powers
Article 2, Section 2 = Commander in chief - controls over the Department of Defense, of the national military, and state national guard units
Expressed Judicial
Article 2, Section 2 = power to gran reprieves and pardons, except in the case of impeachment
Expressed Diplomatic
Article 2 Section 2 = power to make treaties and to receive ambassadors
Expressed Executive
Article 2, Section 3 = see that to it that all laws are faithfully executed (delegated power)
Section 2 = power to appoint, remove, and supervise all executive officers and appoint all federal judges
Expressed Legislative
Article 1, Section 7, and Article 2 Section 3 give the president the power to participate in the legislative process
Presidential Selection Requirements
Natural born citizen
35 years of age
14 year resident of the US
Presidential Removal
25th Ammendment (1951) = Treason, bribery, other high crimes and misdemeanors, impeachment
Presidential Succession
Presidential Succession Act of 1947 = Speaker of the House of Representatives, President pro temporero of the senate, Secretaries of State, Treasury, and Defense, and other cabinet heads in order of the creation of their department
Became constitutional requirement (25th Amendment) in 1965
