A

Surrender of F/A licence and weapons

Vacate any land/building occupied by person at risk (cooling off period) for to to 10 days

How long can you detain to serve a PSO

A

2 hours (from decision made to serve)

Can remove person from premises to station or other place (eg patrol car) during that period

If they refuse to remain, offence and can be arrested

A

Must release the person

You then have 48 hours to serve or it expires

Is a breach of PSO an offence

A

No, but can be taken into custody.

Must bring to court within 24hrs. If can’t be brought within 24 hours must release at expiry of 24 hrs and summons to appear.

How long can you follow up a breach of PSO for

A

You have one month from the breach to locate and bring into custory

You can apply for a WTA which expires after 1 month

A

Continue with existing order
If order expired, issue another up to 10 days
Adjourn to allow DC to issue Temp Protection Order

Can be issued by special circumstances (keeping safe from FV)

A

Respondent holds a firearms licence
Respondent has access to firearms
Service accessed with significant risk
PO is granted without notice

Protection Orders and conditions relating to weapons

A

Respondent must not possess and FAPRAE or hold a licence

Respondent must surrender asap after PO served and within 24 hrs, AND on demand at any time by a constable.

TPO - f/arm licence suspended
Final PO - licence revoked
