Discuss the applicability of 33CFR105 to waterfront facilities
Apply to the owner or operator of any U.S:
- Facility subject to 33CFR parts 126, 127, or 154
- Facility that recieves vessels certified to carry more than 150 passenger (Ex. Cruise Ships), except those vessels not carrying and not embarking or disembarking passengers at the facility.
- Facilities that recieves subject t the internationsal 1974 SOLAS Chapter 11
- Facility that recieves foreign cargo vessels greater than 100 gross tons.
- Facility that receives US cargo vessels, greater than 100 gross tons, subject to 46 CFR Chaoter 1 , subchapter 1, except for those facilities that receive only commercial fishing vessels inspected under 46CFR105.
- Barge fleeting facility that receives barges carrying, in bulk, cargoes regulated by 46CFR Chapter I, subchapters D or O, or certain Dangerous Cargoes.
Discuss the applicability of MTSA to facilities that are not required to comply with 33 CGR 105
Dtermined by the MTSA to be low risk:
1. A facility owned and operated by the US that is used primarily for military purposes.
2. An oil an natural gas production, exploration or development facility regulated by 33CFR126 or 154 if:
- The facility is engaged solely in the exploration, development or production of oil and natural gas.
- The facility doesnt meet or exceed the operating conditions in 33 CFR 106.105
3. A facility that supports the production exploration or development of oil and natural gas regulated by 33CFR 126 or 154 if:
-The facility is engaged solely in the support, exploration or development of oil and natural gas and transport or stores quantities of hazmat that do not meet or exceed those specifies in 49CFR172.800(b)(1) through (b)(6).
- The facility stores less than 42,000 gallons of cargo regulated by 33CFR154
4. A MOBILE facility regulated by 33CFR154
5. An isolated facility that receives materials regulated by 33CFR 126 or 154 by vessel due to the lack of road access to the facility and doesn’t distribute the material through secondary marine transfers.
Discuss Public Access Area (PAA) and requirements for security measures for access control
PAA: is a defined space within a facility that is open to all personas and provides pedestrian access through the facility from public thoroughfares to the vessel.
