Relevance Conditioned Upon Preliminary Fact

When relevance of evidence is conditioned upon the existence of a preliminary fact, the court need only find that there is SUFFICIENT evidence to support (but not necessarily establish) the existence of that preliminary fact

A
Applies to:
1. communicationa between a client and an attorney that
2. were made for the purpose of obtaining or providing legal assistance for the client and
3. were intended to be and kept confidential
document prepared at request of L (communication) in preparation of trial (to obtain legal assistance) + no indifcation that it was shared with anyone other than L (confidential)
