informed consent: patient explicitly give consent through words
implied consent: patient implicitly gives consent through actions
assault vs battery
assault: threat to harm
battery: actual harm
slander vs libel
slander: spoken attack on someone’s character
libel: written attack on someone’s character
duty of care vs reasonable care
- duty of care: legal standard of care
- reasonable care: care given by a reasonable person
liability vs negligence vs malpractice
- liability: direct actions caused harm
- negligence: must prove level of care was not performed intentionally, leading to harm
- malpractice: type of negligence, aka professional negligence
