A
The Equal Protection Clause of the Fourteenth Amendment provides that all persons are entitled to equal protection of the laws. Equal protection issues arise when the government treats similarly situated individuals differently based on classifications among individuals.

A
Because the U.S. Constitution only prohibits governmental infringement of constitutional rights, the litigant must show the action is attributable to the state, which includes government agencies and officials acting under the color of state law.
