  • Attempt conciliation
  • Claimant files ET1 form
  • Defendant must respond within 28 days with an ET3 form
  • May request a case management hearing to establish what claims are being made

  • Most open to public
  • More flexible, less formal
  • ‘Inquisitorial’, panel asking questions
    Both sides can put their case, some have eye witnesses being cross examined
