- Commercial case for 2 days in the High Court would cost £750,000-£100,000 whereas mediating would cost £5000
- Since 2013, winners can only claim costs that are ‘proportionate’ to the value of the claim

- Case management takes place where a strict timetable as to length of hearing, number of witnesses is set
- Minimises delay in case being heard

- Even when successful, no guarantee the D will pay the claimant
- May mean claimant has to take enforcement action
- Adds to cost, claimant may feel its not worth the extra expense

- Appropriate in cases where there are complex legal issues involved
