wrongful dismissal
when an employer breaches the terms of an employee’s contract in dismissing them
eg failing to provide required notice, not following contractual dismissal procedures
unfair dismissal
when an employer dismisses an employee in a way that is unjust or unreasonable
at least 2 years conitnuous work
automatic unfair dismissal
Certain reasons for dismissal are automatically considered unfair, such as dismissal due to pregnancy, whistleblowing, or trade union membership.
potentially fair dismissal
dismissals can be fair if based on legit reason such as conduct, capability, redundancy, statutory illegality or other
constructive dismissal
when employee resigns based on employers conduct which has made their continued employment untenable; significant breaches of contract such as drastic changes
