An employer may appoint any person except a manager to perform any function entrusted
to the employer by subsections 2 and 3
An employer who appoints a person under subsection 1 must
notify the chief inspector of mines of that appointment within 7 days and must include in that notice
the name of the person appointed
the nature of the persons functions
the names of the manager or managers over whom that person has control
An employer who appoint a person under section 4.1 must
supply each persons appointed with the means to perform their functions
and take reasonable steps to ensure that they perform their functions
The appointment of a person under subsection 4.1 does not
relieve the employer of any duty imposed on employers by this Act or any other law
