In applying for a Surveillance Device Warrant you must convince the Judge you have RG…
a) to suspect offence has been, is being or is about to be committed
b) to believe the proposed use of surveillance device will obtain information that is evidential material to the offence.
c) restrictions in Section 45 do not prevent the issuing of a surveillance device warrant in the circumstances.
How long can warrants be issued for?
Granted for a specified time for up to 60 days. The Judge may issue further surveillance device warrants in respect of the same suspected offence.
What do you do with surplus/irrelevant information recieved from Surveillance Devices?
Must be destroyed as soon as practicable. Commissioner of Police is responsible for ensuring all relevant information is destroyed as soon as it appears that no proceedings or further proceedings will be taken regarding the information.
