Powers involved in Controlled Deliveries?
Vested in the Customs Officer Only under Section 12 - MODA 1975.
If operation successful, Police make the arrest and conduct the Prosecution.
What are Controlled Deliveries?
International Mail Centre
- Inside a mail article
International Airport
- Arrival courier using either body packing, internal concealment or concealed within luggage
Imported Air Freight
- Within a freight consignment which can be either commercial or private.
Imported sea Freight
- As with air freight but arrive via sea
Transshipped air or sea Freight
- Transiting through NZ with a final destination in another country.
Arriving commercial vessel
- Hidden on board or attached to a vessel that is either unloading or picking up cargo from NZ before continuing onto another country.
What the two options with Controlled Deliveries?
Option 1)
Clean Controlled Delivery - where no drugs are left in the package.
Eliminates risk of drugs being lost AND reduces risk of alarming targes with pre-arranged surveillance.
ONLY ‘importation’ and/or ‘conspiracy’ charges likely
Option 2)
Leave a small amount for “Possession for Supply” charge.
Provides option for “emergency powers” should drugs move to person or places that are not covered by SW.
What to profile on a package?
Sender Location:
- Phone numbers attached to package
- IMEI/SIM information underaken at early stage (cell data)
- DNA / Fingerprints / Handwriting / Impressions
- Multiple packages including dummy runs to address/associated addresses
What to profile on a delivery address?
Police Intelligence Applications:
- Occupants
- Rubbish delivery dates/times
- Whether Housing NZ address
- Local Council - owner/rates details
- Council Plans
- Photos / Video of address
- Landlord / property owner
- Timing of mail to address
- Previous occupants / Neighbours
- Electricity / Gas supplies to address
- Police staff - previous attendance to address
- Security to address (Animals / Sensor / Security / Locks / etc)
What to profile on the addressee?
Consider:
- Previous occupiers
- Real person / false names
- Connections to delivery address
- Relevant convictions / noting’s / associations
- Travel / Connections to country of origin
- Travel history including passports held
- Full ID of target
- NIA / Previous investigation
- Family members / associates / vehicles / addresses & places frequent
- Photos (Casual / Formal / Surveillance)
- Bank accounts - large deposits, overseas transfers
- General lifestyle (sports and interests)
- Tracking devices for vehicles
- Risk assessment - firearms required
Profiling a Potential Address
Consider:
- Proximity to target address - close enough to be effective, far enough away to be unobtrusive
- Unobtrusive line of sight to target address
- Access to and from address without arousing suspicion (ex - consider equipment staff who need to enter/leave the address)
- Phone lines available on street
- Ability to beam signals and/or tap into Telecom cables
- Other things to consider: Parking, schools, other neighborhood activities.
How to profile occupants?
Consider:
- NIA Check
- Employment
- Power Account
- Credit Checks
Things to consider when approaching occupants?
When profiled address and occupants as suitable. Need to consider:
- Cover Story
- Protection of Identity
- Room available with 24 hours access
- Preferably no children
- Preferably no visitors to the address during operation hours
- Gratuity “Thank You” at investigation conclusion
Searching for Evidence Relating to Importation
Consider:
- Track and trace receipts
- Correspondence
- Emails
- Computers, faxes and cell phones
- Contact lists / numbers
- Packaging from previous importations
- Money and financial records
- Travel documentations
- Passports
Method of Delivery
Consider:
- Re-introduce into postal system for delivery by postie
- Delivery by a Courier Company
- Police / Customs staff pose as courier / Postie
- Consider recording the interaction
If Addressee is not at the delivery address
Consider:
- Leaving package in letter box / door
- Leaving a calling card
- Attempting delivery at a later time
If Addressee accepts package
Consider:
- Monitor audio/tamper devices and crunch when package is opened
- Deciding on length of time to hold cordons
- Staff / Resources
- Other operational commitments
If package goes mobile
Consider:
- Control, communication and risk
- Proximity of tracking/monitor vehicle to target - close enough to be in range, far enough back to avoid being observed
- Crunch cars to keep back and let Surveillance relay the target’s activities
- Need for repeaters to ensure no loss of communication
If target goes mobile with/without the package or vice versa
Consider:
- Control, communication and risk
- Splitting resources and survelling both
- Keeping observations on package location at all times to avoid loss of evidence/equipment
