Applicants must also show:

- location will be practicing bona fide pharmacy
- number of hours each week the pharmacy is open to public
- sufficient stock of emergency and frequently prescribed drugs
- registered pharmacist in personal attendance and on duty when practice of pharmacy is conducted
- pharmacy will be separate from areas containing merchandise not offered for sale under permit (OTC, non drug items)

** well lit and ventilated with clean & sanitary surroundings
** sink with hot and cold water
** proper sewage outlet
** refrigeration
** large enough prescription filling area to permit practice of pharmacy
** additional fixtures, facilities, and equipment required by the board

Permanent Closure
A
- notify the board 20 days before the transfer of controlled substances & submit copy of inventory to DEA with name, address, and DEA number of person drugs are being transferred to
- remove all legend drugs from stock be either returning to wholesaler/manufacturer, transfer to another pharmacy, destroying in presence of board rep
- dispose all controlled drugs and legend drugs and submit the licensed premises for inspection by board rep before disposing of any other merchandise
- remove symbols or words of pharmacy
- return pharmacy permit for cancellation within 10 days of all legend drugs, controlled drugs, and devices being removed

A prescription may not be refilled without a written/electronic/oral authorization EXCEPT:

- pharmacist tried contacting original prescriber
- pharmacist believes that it would be detrimental to health if not refilled
- original prescription authorized a refill but invalid due to expiration or used all refills
- originally filled at this pharmacy or affiliated pharmacy by same parent corporation
- drug is prescribed continuously and been taken correctly
- documents information required for refill, date/time tried calling prescriber
- notifies original prescriber reason for refill in 1 business day
- may not be more than quantity prescribe or 30 day supply, whichever is less
- not more than 1 emergency fill in 6 month period
- not a controlled substance
