Duties to the court (5)

A

A barrister has a paramount duty to the court and administration of justice (r 25) Must not knowingly mislead or deceive the court (r 26).

Must take all necessary steps to correct any statement that was misleading (r 27).

Must inform the court of any binding authority or legislation even if is directly in favour of opponents case (r 31).

Barrister who suspects the prosecution is not aware of the client’s previous conviction must not ask prosecution witness about any previous convictions in hope of a negative answer (r 35)
