What are the 3 levels of delivery?
- Actual
- Constructive
- Attempted
Example: You see Person A hand a bindle of methamphetamine to Person B. B then hands A $10. A
committed DCS methamphetamine based on an actual delivery of meth.
What level of delivery?
When B received the drugs, B committed PCS meth by being in ACTUAL possession of the meth.
Example: You see person A hand a bindle of methamphetamine to Person B. B then hands A $10. After arresting A for DCS, they tell you they were delivering the drugs for person C and that C
arranged the delivery. They show you text messages from C that confirms their story.
What level of delivery?
Person C committed CONSTRUCTIVE delivery of meth (person A still committed DCS for actual delivery).
Example: You arrest a person on a warrant. While conducting an inventory search on the person’s
backpack, you find four 2-gram (g) baggies of heroin, three empty baggies, and a scale. When
interviewed the person admits they were on their way to meet a friend to sell them the baggies
of heroin.
What level of delivery?
The person committed DCS by ATTEMPTED delivery of heroin.
